After China’s WTO accession, how to properly handle the foreign investment in finance sector is becoming more and more urgent. According to the commitments made by Chinese government and the related agreements, the Foreign Investment Law must be developed and the accession requirements of foreign investments must be deregulated. Unquestionably, the reform of the regulations of foreign investments has a great influence to China’s economic life, but from a long-term view, this reform is favorable to the overall economy. With China’s accession to WTO, the field of trade in services, which is the first sector to be opened for foreign investments, faced great challenges and difficulties. Since China adopted Reform and Open-up Policy in late 1978, foreign investments have brought great economic benefits to China’s economy, though some problems also influenced our daily life, such as the employment and the monopolization of some industry. So, how to balance the introduction of foreign investments and the development of China’s national economy is an urgent issue.This article takes China banking as its researching object. Because of its special and significant position in one country, especially in concern of the representative problems from banking, the reference idea with high potential use should be made available to the finance and other branches like service and trade, if only we choose this object. In this article, on the basis of explaining the general situation of our laws on supervision to the foreign investment in banking, this paper separates different chapters to separately address on the system of supervising mode, of market admittance supervision, of supervising method and market exiting supervision, where the advanced ideas from foreign developed countries (especially UK, US and Japan, etc.) is introduced, together with opinions from corresponding scholars, before finally submitting the advice on how to consummate correlative systems.
