With the rapid development of the Internet, the unfair competition concerning domain name has become more and more popular. The flinty challenge roused to traditional international property law makes the shortcomings of the current law more obvious than before.This thesis analyses the correlative law execution practice and legislative experience in America, Japan, and some international organizations, deeply and comprehensively expounds the problems about the unfair competition concerning domain name on the conditions of our country. On the basis of the above discussion and former research productions, this thesis tries to put forward constructive suggestions to the consummation of China law system in this field.Besides preface and epilogue, this thesis includes four chapters. The first chapter mainly introduces the conception, embodiment forms and essential characters of the unfair competition concerning domain name. This part also discusses the differences between the unfair competition actions concerning domain name and traditional unfair competition actions.The second chapter introduces and analyses, from the aspects of substantive law and procedural law, the main measures of WIPO, ICANN, America and Japan in regulating the unfair competition concerning domain name.The third chapter introduces and analyses accordingly the current law and other regulations in dealing with the unfair competition concerning domain name in our country. In the mean while, this part points out the main problems existed.The fourth chapter is about the legal system for improving the institution of Anti-unfair Competition of domain name.
