Predatory Pricing is one kind of exclusionary behaviors. It is the basic theory of industrial economics. Many countries make laws to punish this behavior. Because of the nature of market economy and the diversity of the company behaviors, it is hard to make a clear line between the normal cut-down pricing and the predatory pricing. in appearance, predatory pricing looks like normal cut-down pricing, and it also makes use of the right of making price which belongs to the company. As a result, there is little of successful cases in predatory pricing .How to understand and make sure the behavior of predatory pricing is a hard question for economists and lawyers, especially the latter.European Union is a fine example of regional economical integration. Countries follow the EU competition law. Furthermore, Global Competition Law Center is set down in Europe. But even in European competition law, there is also weakness in predatory pricing. Recently, many scholars have got down to researching this question. At the same time, the limited results are centralized in the theory of economic. It is rare in the law.This thesis analyses a lot of foreign data. On the basis of economic theory, make clears what predatory pricing is. Then analyses the constitutive elements and standards of predatory pricing. Focus on the rules of European competition law, the author finally put forward the suggestion.
