With the increasing competition of comprehensive nationalstrength in the world today, the international situation has undergonesignificant changes. Education interacting with into economic andpolitical interacting, which is both the reality of the competition ofcomprehensive national strength, also is a major strategic of countriesto defend and realize their national interests. Since the1990s, Chinahigh education has gradually embarked on a market-oriented,large-scale road and the enrollment rate is greatly improved which hasmade the positive effects to Chinas higher education. However theirnegative effects can not be ignored. The market also brought aboutsome social injustice or “high education injustice”.To make the education equity is not just to improve the legal system,the deeper significance is to make effect to the social stratification andsocial mobility. The fairness of education means the equity of the socialmobility. High education, especially the elite schools contain varioustypes of relationships, status and nature manifest themselves in theintergenerational mobility through the power deeply.The social choiceand social mobility are two core factors of the education equality,The power in the domain of high education plus the capital formedby the knowledge and culture which come from it, have animmeasurable effect on individuals and society. Education equity,under the protection of the Higher Education Law will directly lead tosocial justice, impact on the cultural capital in the distribution,possession, inheritance, and circulation in the equality.Through to study of the equity of High Education, to seek to way toprotect all sectors of the legitimate rights and interests, especially ofthose disadvantaged social strata, to make all different groups haveequal right to education as well as the direction of development.In the new era of social development, the study of the equity of higheducation means more far-reaching under a more people-orientedsocial consciousness.With the development of economic and deepening of educationreform, We need to reform and improve the High Education Law,including the innovation of educational equity theory which hasbecome the major theory and issue of the current educational reformand development. The essay states the study of equity of HighEducation as the threshold of the legal theory. To make the startingpoint of the core values of the Law through the phenomenon ofanalysis of the essence, try to find a solution to the injustice of the higheducation from the root.Put forward a series of feasibility of proposals tofurther enrich the theoretical study of the equity of higher education.
