Establish an efficient modern agricultural land property rights system under market-oriented, and improve the farmers’land property rights system to protected farmers’land property rights and interests in the process of marketization is not only the major topics of current theoretical study, but also the realistic way to further deepen rural reformand solve the three rural issue. The current research on agricultural land property rights system have already been multi-perspective and more in-depth analysis. The understanding of the structure of agricultural land property rights is based on the perspective of the legal rights, taking into account the differences between the subjects of rights and its affect among various rights constitute, But it is too broad and abstract.The acquisition of property rights is determined by property ownership, political system, legal and moral and ethical. In this paper, using Barzel property rights theory to analyze the agricultural land ownership structure of China, and discuss how to optimize the structure of agricultural land property rights. Then, combing the present stage of agricultural land property rights system briefly, and it shows that the agricultural land property rights is ambiguous, the property rights owned by the state, rural collective organizations and farmers, the three parties (especially between the rural collective economic organizations and farmers) interact and restraint each other to control parties right when exercise the control rights, it is only be determined through negotiation or even bargaining. To explore the mechanisms involved, the reseach based on the analytical framework before, using Barzel’s analysis paradigm to the different value of agricultural land property, construct a raw agricultural land property rights model of government behavior. Division of land in the public domain Ⅰ, Ⅱ, Ⅲ, and re-interpretation of the relationship between ownership of land between the countries, the rural collective organizations and farmers. Put forward a hypothesis to be tested. In this regard, the reliability and validity, the empirical data obtained from the household survey conducted exploratory factor analysis, validation hypothesis. Then economics analysis in the public domain, and finally from the perspective of public domain, using a logistic model analysis of the transfer of agricultural land is entirely impact factors were analyzed. Get the following basic conclusions:(1) Agricultural land property rights has four sources:First, the land owners directly exercise the exclusive rights of land property; pay the cost of the land owners or others to grab the public domain I; the Government to consider the costs and benefits to grab land "publicfield Ⅱ "in some of the valuable property rights; is part of the valuable property rights of others other than outside the land owner with a competitive advantage to grab the public domain III. Different proportions of these four sources constitute the country’s agricultural land property rights structure.(2) Use of the Barzel theoretical right to the transfer of agricultural land completely the effects of factors studies have shown that the optimization of agricultural land property rights structure is smaller in the public domain, the property rights of agricultural land more full and complete. Farm income effects of land inflow per capita income effects of land outflow. The per capita income is not high, and peri-urban farmers an inevitable choice for concurrent business. Also resulted in new features of the land transfer, and peri-urban farmers to grain phenomenon.(3) The optimization of the structure of property rights is in the public domain is shrinking, while the public sphere factor is determined by the institutional environment. Agricultural land property rights system is not an isolated system, it is bound to its institutional environment to adapt its institutional environment is determined. Promote the institutional environment of self-evolution and change, the system of property rights will change accordingly. The improvement of the institutional environment to improve the income of agricultural land property rights, or be able to reduce the execution cost of the property rights of agricultural land.Based on these results, the policy recommendations:to further improve the legal system of agricultural land property rights, foster farmers’organizations in the modern agricultural land property rights system to speed up the construction of the agricultural land market system, the establishment of a sound agricultural land property rights system to match the security system.
