A Study on Organized Travel Contract

Nowadays, Tourism activities have become more popular and complicated social relationships have formed in them. One of the special relationships is the travel contract relationship. However, China’s Tourism legislation relatively lags behind and the theoretic studies on them have been relatively weak in the field of legal research. In judicial practice, a large number of travel disputes cannot be solved well according to the existing legal provisions. Since travel contracts consist of organized travel contracts and travel agency services contracts and the former is the main stream in current tourism market, this thesis mainly studies on organized travel contracts.According to the basic principles of civil laws and creditor’s rights and contract laws, the thesis compares the legislative regulations in the typical travel contracts in many areas and countries.The thesis consists of seven parts.PartⅠis the definition of organized travel contracts.PartⅡRights and Obligations of organizer in organized travel contracts.PartⅢ,Rights and Obligations of tourist in organized travel PartⅣThe alteration and termination of organized travel contract.PartⅤLegislative methods of constructing China’s Systems of organized travel contracts.The conclusion part generalizes all the contents of the thesis.
