Effectiveness of Maitenance Agreement by Will : A Contract Law Perspective

For a long time, the understanding and interpretation of the legacy-support agreement is limited to within the framework as a way of succession , rarely concerned about the same time as a special contract . As a special contract , legacy-support agreement with other contract , in the case of Succession Act did not make special provisions applicable contract law and the relevant provisions of the General Provisions : legacy-support agreement may also exist revocable effectiveness to be defects , and thus the effectiveness of competing on a given force ; different effect determination dependents may elect to exercise the different claims , so that the outcome of the case is very different . In this paper, a case leads to the thinking of the validity of the legacy-support agreement : legacy-support agreement undetermined effect , can be revoked or their rights guaranteed obligations defects and three cases will lead to what the legal consequences . The article is divided into the following sections: issues raised , and the effectiveness of legacy-support agreement to dispose of the property of others identified the presence of defects and recommend appropriate approach for different categories of effectiveness , the current legal system .
